The way it will come out is: individual right, subject to reasonable
regulation, a test for reasonableness, and a finding that total ban on
type of gun that has legitimate defensive uses passes the test.
The most hilarious moment was when DC gave their fallback "OK, so
maybe there's an individual right, but it's subject to reasonable
regulation, and a total ban on handguns of all kinds is reasonable,
cuz there are other kinds of guns you could buy (waterpistols
perhaps)" to which Big John replied "I see. So a total ban on books is
compatible with the First Amendment providing people are permitted to
buy magazines?" Love it.
This will be one for the history books. And I assure you it is totally
coming; Kennedy's onboard and that's what they need. Reason being,
Akhil Amar, who is like Mr. Totally-into-guns-but-in-a-cuddly-liberal-
way, wrote this huge encomium to Kennedy's wisdom and judiciousness
some years ago. Flattery will get you everywhere.
